GENERAL TERMS AND CONDITIONS OF SALE (ENGLISH)
Last updated: 21 September 2026
1. Seller
Abbie Smith, sole proprietor (EI), trading as Abbie Smith Photography, 6 rue d'Entraigues, 37000 Tours, France. SIRET 109 313 049 00016. Email: abbiesmithphotos@gmail.com. VAT: not applicable, article 293 B of the French General Tax Code (CGI).
2. Scope
These terms apply to all sales of services and products made by Abbie Smith Photography (the "Seller") through this website, by email, or in person, to individual customers (the "Client"). Sales to professionals are covered by section 15. By booking, the Client confirms having read and accepted these terms. The version in force on the date of booking applies.
3. Services and products
The Seller provides portrait photography sessions for couples and families in the Loire Valley. The essential characteristics of each offer (session duration, location, number of people included, number of edited photographs delivered, delivery format) are described on the website or in the quote, and are repeated in the booking confirmation.
Current pricing is available on request by email, and is listed on the website's offers page.
Editing style and artistic choices are at the Seller's discretion, within the style shown in the portfolio.
4. Prices
Prices are in euros. The Seller is not subject to VAT, so the price shown is the final price payable. The price in force on the day of booking applies.
Sessions within 30 km of Blois include travel. Beyond this distance, a travel fee may be applied and will be confirmed at the time of quote.
Entrance fees, permits, or venue charges required by a site (for example a château or garden) are not included in the price and are paid by the Client.
5. Booking and payment
A booking is confirmed when the Client has accepted these terms and the offer (by email or through the contact form), and has paid the session fee. The session fee is refundable as follows:
30 days before the session: 100%
14 days before the session: 50%
7 days before the session: 25%
Accepted payment methods: bank transfer, card payment through Stripe.
In case of late payment, the Seller may suspend delivery of the photographs until the full amount has been paid. Please see #9 for right of refusal information.
6. The session
The date, time, and location are agreed in advance. If the Client is more than 30 minutes late, the session may be shortened without change in price.
Sessions are mostly outdoors. If the weather makes the session impossible or unsafe, it will be rescheduled free of charge by mutual agreement.
Children remain under the supervision and responsibility of their parents or an accompanying adult throughout the session. The Client follows the rules of the places visited. Some sites require authorization for professional photography, and the Client will be told if this applies.
7. Delivery
The edited photographs are delivered within 2 weeks after a portrait session, or 1 week for business sessions, through Fotostudio. The number of photographs delivered is stated in the offer.
The online gallery is available for 1 month after delivery. It is the responsibility of the client to download their images within this time. Images are held for 12 months after the session. After that date, files are deleted. The Client must download and back up the photographs within this period.
8. Cancellation and rescheduling
By the Client: the Client may reschedule the session free of charge with at least 48 hours notice. If the Client does not attend the session, the deposit is non-refundable.
By the Seller: if the Seller cannot hold the session (illness, force majeure), the session is rescheduled to a date that suits the Client, or all amounts paid are refunded if no new date is possible.
9. Right of withdrawal (individual Clients)
When a booking is made at a distance (online, by email, or through the contact form), the Client has 14 days from the booking confirmation to withdraw without giving a reason. To withdraw, the Client sends a clear statement to abbiesmithphotos@gmail.com stating their intent to withdraw. If the Client asks for the session to take place before the end of the 14 days, by signing a contract for a date before the end of the 14 days, the Client is stating that they are aware that the session will take place before the 14-day window.
If the service has been fully performed before the end of the 14 days, at the Client's express request, and with the Client's acknowledgement that the right of withdrawal is lost once the service is fully performed, there is no right of withdrawal.
The right of withdrawal also does not apply to personalized products or to digital files delivered after the Client's express agreement and acknowledgement that the right of withdrawal is lost.
Amounts owed to the Client are refunded within 14 days of the Seller being informed of the withdrawal.
10. Legal guarantees and after-sales service
The digital photographs delivered to the Client are covered by the legal guarantee of conformity for digital content, under articles L. 224-25-12 and following of the Consumer Code, and by the guarantee against hidden defects under articles 1641 and following of the Civil Code.
Under the legal guarantee of conformity, the Seller is liable for any lack of conformity that exists at the time of delivery and that appears within two years of delivery. If a delivered file is damaged, incomplete, or does not match the order, the Client should contact the Seller at abbiesmithphotos@gmail.com with details of the problem, and the Seller will repair, replace, or refund it as the law provides.
No commercial warranty beyond the legal guarantees above. The Seller does not charge any additional cost for remote communication for after-sales requests related to defects.
11. Intellectual property and use of photographs
The Seller remains the author and holder of the copyright in all photographs. The Client receives a non-exclusive licence to use the delivered photographs for personal, non-commercial purposes: sharing with family and friends, personal social media, and personal printing. Any commercial use, resale, or publication in the press requires the Seller's prior written agreement.
The Seller may use the photographs in her portfolio, on her website, on social media, and for promotion only with the Client's written permission. The Client may refuse or withdraw this permission at any time, with no effect on the booking or the price.
12. Personal data
The Seller processes personal data as described in the Privacy Policy.
13. Liability and force majeure
Nothing in these terms limits the rights that the law grants to consumers. Subject to that, the Seller is liable only for direct damage, and her liability is limited to the amount paid for the service concerned.
Neither party is liable for a failure to perform caused by force majeure: events beyond their control such as severe weather, serious illness, strikes, or the closing of a site. The session is then rescheduled, or amounts paid for the part not performed are refunded. Outside of the 14-day cooling off window, refunds follow policy in section 5.
14. Consumer mediation, applicable law, and courts
In case of a dispute, the Client should first contact the Seller at abbiesmithphotos@gmail.com to find a solution.
If no solution is found, the Client may use, free of charge, a consumer mediator:
MÉDIATION CONSOMMATION DÉVELOPPEMENT
These terms are governed by French law. A Client living in another country keeps the protection of the mandatory consumer rules of that country. The Client may bring a dispute before the courts of the place where the Client lives, or before the courts of Tours as the law allows.
15. Professional clients
Sales to professional clients are governed by separate terms, provided directly as part of a business proposal upon request. Please contact abbiesmithphotos@gmail.com for details.
Liability and force majeure: as in section 13.
